What is Insurance Bad Faith?
Many of us make monthly insurance premium payments for years and never have to make a claim. When we make those payments we are reassured that if something unexpected does happen, we will have insurance coverage to help us. Most of the time insurance companies settle insurance claims for accidental injury or loss fairly, but not always. No one wants the surprise of learning that their own insurance company is working hard to deny coverage or unfairly reduce the settlement amount. When insurance companies do this it is called “insurance bad faith.” It is a legal term used when insurance companies are not fulfilling their legal obligations to their customers.
Our attorneys at Treon & Shook PLLC have decades of collective experience with insurance companies and we hold them accountable. We understand the obligations insurance companies have to their customers and we fight to ensure that our clients’ valid claims are fairly covered. Our AV-rated* attorneys have battled successfully against insurance companies including State Farm, Allstate, Farmers, Safeco, and American Family.
Having Trouble with Your Insurance Company?
Sometimes it is hard to tell that you are in a bad faith situation. Our lawyers can help figure this out. We have experience with the following types of insurance bad faith litigation:
- Property loss from fire, smoke, or water damage
- False accusations by insurance companies (accusing policyholders of fraud)
- “Low ball” insurance offers for valid claims, including omission of coverage for items and costs that the policy covers.
- “Slow ball” insurance offers for claims which require immediate attention (such as roof damage after a storm)
- Inadequate investigation into a claim
- Denial of a type of claim arising out of “catastrophic” or storm-related damage such as wildfire smoke damage
In addition to insurance bad faith litigation for homeowners’ policies, we represent clients who have been denied claims from health insurance, auto insurance, life insurance, and disability insurance.
